Commercial litigation frequently becomes a battle in which experts communicate and defend their analyses and opinions. The expert with the more convincing testimony– based on the conclusions in his or her written report–may be a deciding factor in the case. An effective expert written report augments the attorney’s legal arguments about whether the plaintiff suffered damages. It is an important basis for educating the trier of fact about the reasons for either accepting or rejecting the plaintiff’s lost profits claim.
