Learning Objectives:

The session materials, discussions, and explanations will assist the participant to achieve the following learning objectives:

  • Understand the characteristics and nuances of the ex ante/business valuation versus ex post/lost profits approaches to measuring economic damages
  • Select an appropriate and defensible approach
  • Compute total damages representing appropriate compensation to replace any economic loss by plaintiff
  • Avoid or rebut any challenge to limit or exclude the expert's testimony about damages
